- Who is impacted: The proclamation applies only to H-1B petitions filed on or after September 21, 2025.
- Who is not impacted: Individuals with pending or approved H-1B petitions or a valid H-1B visa should not be subject to the new restrictions and may continue travel and entry to the United States (though some delays may occur as agencies adjust procedures).
- Renewals: Petitions and renewals filed before September 21 are not affected by the proclamation. It appears that a renewal will not be treated as a new petition.
- $100,000 Fee Requirement: The new fee applies only to new H-1B petitions filed on or after September 21, 2025 for foreign nationals currently outside the United States for entry into the United States. Further government guidance is expected.
